These Terms of Service ("Terms") are an agreement between you and Band of Rabbits ("we," "us") about your use of the Orbit 99 mobile game and related services (the "Game"). By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, please do not use the Game.
The Game is intended for players 13 and older. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms for you.
We give you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game on devices you own or control, for your own non-commercial entertainment. You may not:
The Game is free to download and play. It shows advertising, including a banner ad and optional rewarded video ads that you can choose to watch in exchange for in-game benefits such as continues, refills, or cosmetic unlocks.
In-game currency (such as gems), continues, refills, and cosmetic items ("Virtual Items") have no real-world monetary value. They cannot be sold, transferred, or exchanged for money or anything of value. They are licensed to you, not sold. Virtual Items may be lost if you uninstall the Game, clear its data, or change devices, and we may change, rebalance, or remove Virtual Items at any time.
We do not currently sell anything for real money inside the Game. If we ever add paid purchases, they will be processed by Google Play and covered by Google Play's refund policies, and we will update these Terms.
Rewarded ads are provided by third-party ad networks (Google AdMob). We cannot guarantee that an ad will always be available or that a reward will always be delivered. If a reward fails, contact us and we'll do what we reasonably can.
Leaderboards and achievements run through Google Play Games Services and are subject to Google's terms. We may remove scores that we believe were obtained through cheating, bugs, or exploits, and we may reset leaderboards at any time. Leaderboard rankings do not entitle anyone to a prize unless we publish separate official rules for a specific contest.
The Game, including its code, artwork, characters, music, sound, text, the Orbit 99 name, the Band of Rabbits name, and the Band of Rabbits rabbit logo, belongs to Band of Rabbits or its licensors and is protected by intellectual property laws. Except for the limited license above, these Terms give you no rights to our content or trademarks.

We may update, change, suspend, or discontinue the Game or any feature at any time, with or without notice. Some features (ads, leaderboards, rewards) require an internet connection. Core gameplay may work offline.
You can stop using the Game at any time by uninstalling it. We may suspend or end your access if you break these Terms. Sections 3 (Virtual Items value), 5, 9, 10, 11, and 12 survive after your access ends.
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise that the Game will be error-free, uninterrupted, or free of harmful components, or that your progress, scores, or Virtual Items will be preserved.
TO THE FULLEST EXTENT PERMITTED BY LAW, BAND OF RABBITS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, VIRTUAL ITEMS, OR PROFITS, ARISING OUT OF OR RELATED TO THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE GAME WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $10. Some places do not allow these limits, so they may not fully apply to you.
The Game uses third-party services, including Google Play, Google Play Games Services, and Google AdMob. Your use of those services is governed by their own terms and policies, and we are not responsible for third-party ads, content, or services.
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Michigan, unless the law where you live requires otherwise. Nothing in these Terms limits any consumer rights you have that cannot be waived by contract.
We may update these Terms from time to time. When we do, we'll change the "Last updated" date above. If you keep playing after an update, you accept the new Terms.
